Terms of service

TERMS OF SERVICE

OVERVIEW

Welcome to Collins Custom Products. The terms “we,” “us,” and “our” refer to Collins Custom Products LLC, doing business as Collins Custom Products (“Collins Custom Products”).

Collins Custom Products operates this store and website, including all related information, content, features, tools, products, custom products, and services in order to provide you, the customer, with our Services. Collins Custom Products is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you access or use the Services or purchase products or services from us.

Please read these Terms of Service carefully. They include important information concerning custom and personalized merchandise, artwork approval, order cancellation, warranties, and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have the consent of a parent or legal guardian where required.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide information such as your email address, billing information, payment information, shipping information, and other information necessary to complete your order.

You represent and warrant that all information you provide is accurate, current, and complete and that you have all rights necessary to provide that information.

You are solely responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person without our permission.

SECTION 2 — OUR PRODUCTS AND SERVICES

We make reasonable efforts to accurately represent our products and services. However, colors and product appearance may vary from what is displayed on your screen because of differences in monitors, devices, lighting, materials, dye lots, manufacturing processes, and other factors.

Minor variations that are customary or unavoidable in apparel, promotional products, embroidery, printing, heat-applied decoration, engraving, patches, or other manufacturing and decoration processes are not considered defects.

Examples may include reasonable variations in:

  • garment or material color;
  • thread, ink, transfer, patch, or engraving appearance;
  • decoration placement;
  • manufacturer sizing;
  • texture or material characteristics; and
  • dimensions within normal manufacturing tolerances.

We do not guarantee that colors displayed electronically will exactly match the physical product.

All product descriptions and offerings are subject to change without notice. We reserve the right to discontinue products and to limit quantities offered to any person, business, geographic area, or jurisdiction.

Custom and Made-to-Order Products

Many products sold by Collins Custom Products are customized, personalized, decorated, manufactured, embroidered, printed, engraved, or otherwise produced specifically for an individual customer or organization.

Because these products are made specifically for the customer, they may be subject to different cancellation, return, and exchange rules than ordinary off-the-shelf merchandise. Please review our Refund and Return Policy before placing your order.

Sizing

Customers are responsible for selecting the correct garment size unless otherwise expressly agreed in writing.

Manufacturer sizing can vary between brands, styles, and garments. Size charts are provided for guidance when available.

A customized product generally cannot be returned or exchanged solely because the customer selected an incorrect size.

Customer-Supplied Products and Materials

When we agree to decorate, engrave, embroider, print, alter, or otherwise work on products or materials supplied by the customer, the customer acknowledges that such work involves manufacturing processes that carry some risk of damage.

We will exercise reasonable care when working with customer-supplied property. However, unless otherwise agreed in writing, Collins Custom Products does not guarantee replacement at full retail value for customer-supplied merchandise damaged as a result of an unavoidable or ordinary production risk.

Nothing in this provision excludes liability that cannot legally be excluded.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase products or services from Collins Custom Products. We reserve the right to accept or decline an order for legitimate business reasons, including product availability, pricing errors, inability to produce the requested customization, suspected fraud, or concerns regarding intellectual-property rights.

An order is not considered finally accepted until we accept the order and any required payment, deposit, artwork, specifications, or approvals have been received.

Please review your order carefully before submitting it.

Custom Order Changes and Cancellations

For customized, personalized, decorated, embroidered, printed, engraved, or made-to-order products, changes or cancellations may not be possible once any of the following has occurred:

  • production has begun;
  • custom materials or merchandise have been ordered;
  • artwork or a production proof has been approved;
  • an applicable team or group ordering deadline has passed; or
  • other nonrecoverable costs have been incurred specifically for the order.

If a cancellation is requested before production begins, we will determine whether the order can reasonably be canceled and whether any nonrecoverable costs have already been incurred.

Team, Company, School, and Group Orders

Products offered through a team, company, organization, school, club, or other group ordering program may be produced together after a specified ordering period closes.

Customers are responsible for placing their orders before the stated deadline.

Once the ordering period closes or production begins, whichever occurs first, changes or cancellations may not be possible.

Group orders may be distributed collectively through a designated organizer, team representative, employer, school, or other contact when that fulfillment method is specified at checkout or on the applicable product page.

Business Customers

Products and Services may be purchased for personal, organizational, or legitimate commercial use.

Nothing in these Terms prohibits businesses, teams, schools, nonprofit organizations, clubs, or other organizations from purchasing products from Collins Custom Products for their own authorized use.

Products may not be resold as Collins Custom Products products or represented as being manufactured or endorsed by us unless we have expressly agreed to such arrangement.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].

SECTION 4 — PRICES, QUOTES, AND BILLING

Prices, discounts, promotions, and quotations are subject to change as permitted by law.

The price charged for an online product will generally be the price in effect when the order is placed and will be shown in the applicable checkout or order confirmation.

Unless otherwise expressly stated, posted prices do not include applicable sales taxes, shipping, handling, customs duties, import charges, or other governmental charges.

Custom quotations may contain additional terms concerning pricing, deposits, production quantities, artwork preparation, shipping, payment schedules, and expiration dates. Where a written custom quotation or order agreement contains terms specific to an order, those order-specific terms will control to the extent they conflict with these general Terms.

Prices offered through private team, company, or organization stores may differ from prices offered through our general public store.

You agree to provide current, complete, and accurate purchase, payment, and account information.

You represent that you are authorized to use any payment method provided and agree to pay all valid charges associated with your order, including applicable shipping and taxes.

SECTION 5 — SHIPPING, DELIVERY, GROUP FULFILLMENT, AND PICKUP

Production time and shipping transit time are separate.

Any stated production time represents an estimate of the time required to produce or prepare the order before shipment or pickup. Any carrier delivery estimate begins after the order has been completed and transferred to the applicable carrier.

Unless we expressly state otherwise, production and delivery dates are estimates rather than guarantees.

We are not responsible for carrier delays, weather events, customs delays, transportation interruptions, natural disasters, or other circumstances outside our reasonable control.

Shipping Addresses

Customers are responsible for providing a complete and accurate shipping address.

If an order is returned, delayed, or misdelivered because of an incorrect or incomplete address supplied by the customer, additional shipping charges may apply before the order can be reshipped.

Local Pickup

Orders selected for local pickup should not be collected until the customer receives confirmation that the order is ready.

Pickup availability dates are estimates and may depend upon completion of customization or production.

Group Fulfillment

Certain team, school, company, club, or organization orders may offer a Group Distribution, Team Distribution, or similar fulfillment method.

When this option is selected, the customer’s individual order will generally be produced as part of the group’s combined production run and delivered to or collected by the organization’s designated representative rather than shipped separately to the individual customer.

Risk of Loss

Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 6 — INTELLECTUAL PROPERTY AND CUSTOMER ARTWORK

Our Services, including our trademarks, business names, text, photographs, graphics, product images, videos, designs, website elements, and other content owned by Collins Custom Products or our licensors, are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for lawful personal or business purchasing purposes. You may not reproduce, distribute, modify, publicly display, republish, or commercially exploit our protected content without our permission except as permitted by law.

Collins Custom Products’ names, logos, product and service names, designs, and slogans are trademarks or trade dress of Collins Custom Products LLC where applicable.

Shopify’s trademarks remain the property of Shopify, and third-party trademarks remain the property of their respective owners.

Customer-Supplied Artwork and Intellectual Property

Customers frequently provide logos, artwork, photographs, trademarks, names, slogans, graphics, or other content for use on customized products.

By providing any such content to Collins Custom Products, you represent and warrant that you either own the content or have received sufficient authorization from the applicable rights holder to reproduce and use the content for the requested order.

You grant Collins Custom Products LLC a limited, nonexclusive license to reproduce, modify as reasonably necessary for production, digitize, vectorize, print, embroider, engrave, transfer, manufacture, and otherwise use the submitted content only to the extent reasonably necessary to prepare, produce, fulfill, document, or reproduce your requested order.

We may decline to reproduce artwork where we reasonably believe doing so could violate intellectual-property rights, applicable law, or our policies.

You agree to be responsible for claims arising from artwork or other material you supplied when you did not have authorization to use that material.

Digitizing and Production Files

Unless expressly agreed otherwise in writing, embroidery digitizing files, production files, machine files, setup files, working artwork, templates, or other production assets created internally by Collins Custom Products remain the property of Collins Custom Products.

Payment for a finished decorated product does not automatically constitute the purchase or transfer of such internal production files.

SECTION 7 — ARTWORK AND PROOF APPROVAL

When we provide a proof, mockup, artwork preview, sample, or other representation for customer approval, the customer is responsible for carefully reviewing it before approving production.

Approval authorizes Collins Custom Products to proceed based upon the approved specifications.

Customers should verify, as applicable:

  • spelling and grammar;
  • names and numbers;
  • artwork;
  • logo version;
  • dimensions;
  • colors;
  • decoration location;
  • quantities;
  • garment or product selection; and
  • any other customer-specific information shown in the proof.

Once a proof has been approved and production has begun, changes may require additional charges or may no longer be possible.

Electronic colors and mockups are representations only and may not exactly reproduce the appearance of physical thread, ink, transfers, garments, wood, leather, metal, acrylic, or other materials.

SECTION 8 — OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have control over.

You acknowledge and agree that we provide access to such tools “as is” and “as available,” without warranties, representations, or endorsements except where otherwise required by law.

Any use of optional third-party tools is at your own discretion, and you should review the terms applicable to those third-party services.

We may offer new tools, resources, or features in the future, and such features will also form part of the Services where applicable.

SECTION 9 — THIRD-PARTY LINKS

The Services may contain hyperlinks, embedded features, or materials provided by third parties.

We are not responsible for examining or evaluating the accuracy or content of third-party websites or services that you independently choose to access.

Purchases or transactions with unrelated third parties may be governed by that third party’s terms and policies.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

Collins Custom Products is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and Collins Custom Products LLC.

Shopify is not the seller of products offered by Collins Custom Products and is not responsible for the manufacturing, customization, quality, or fulfillment of products purchased from us except to the extent Shopify separately provides payment, platform, or other services subject to its own terms.

SECTION 11 — PRIVACY POLICY

Personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here [LINK].

Certain personal information may also be processed by Shopify in accordance with Shopify’s applicable privacy policies.

Because the Services are hosted by Shopify, information submitted through our store may be transmitted to Shopify and other service providers necessary to operate our store, process transactions, prevent fraud, fulfill orders, and provide the Services.

Please review our Privacy Policy for additional information.

SECTION 12 — FEEDBACK

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, photographs, images, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.

We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve, and promote the Services and to perform our obligations and exercise our rights under these Terms.

You represent and warrant that:

(i) you own or have all necessary rights to the Feedback;

(ii) you have disclosed any compensation or incentives received in connection with your submission; and

(iii) your Feedback complies with these Terms.

We are under no obligation to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback.

We may, but have no obligation to, monitor, edit, or remove Feedback that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, otherwise objectionable, or violates another party’s intellectual-property or other rights.

You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights.

You further agree that your Feedback will not contain unlawful, abusive, obscene, or malicious content, computer viruses, malware, or other material that could affect the operation of the Services or related websites.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties regarding the origin of Feedback.

You are solely responsible for the Feedback you submit and its accuracy. We take no responsibility and assume no liability for Feedback posted by you or any third party.

SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.

We reserve the right to correct errors, update information, and cancel or modify an affected order when necessary, subject to applicable law.

If an order is canceled because of a material pricing or listing error, amounts already paid for the canceled portion of the order will be refunded.

SECTION 14 — PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to violate applicable law; infringe intellectual-property rights; transmit malicious software; engage in fraud; harass others; impersonate another person or business; collect information unlawfully; interfere with website security; or otherwise misuse the Services.

You may not reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services without authorization.

You may not use robots, spiders, scraping tools, automated data-gathering systems, AI tools, agents, or other automated or manual means to access the Services in violation of our technical restrictions or policies.

We may restrict or terminate access to the Services when we reasonably determine that these Terms have been violated.

SECTION 15 — AUTOMATED AGENTS

This section applies if you use, allow, enable, or cause the deployment of an automated or semi-automated software system or service (“Agent”) to access, use, or interact with the Services.

Agents may not access or interact with the Services in violation of applicable law, our technical restrictions, or any instructions communicated by Collins Custom Products or Shopify.

Agents may not conceal or misrepresent their automated nature, circumvent CAPTCHAs or other access controls, bypass security measures, or otherwise evade measures intended to regulate automated access.

We may limit or prohibit automated access to the Services at our discretion where permitted by law.

SECTION 16 — TERMINATION

We may suspend or terminate access to some or all of the Services when permitted by law, including where a user materially violates these Terms or engages in fraudulent, unlawful, abusive, or harmful activity.

Termination does not relieve either party of obligations that accrued before termination.

Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, payment obligations, liability, indemnification, and governing law.

SECTION 17 — DISCLAIMER OF WARRANTIES

The information presented through the Services is provided for general informational purposes.

Except for warranties expressly provided by Collins Custom Products or rights and warranties imposed by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that access to the Services will be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes or limits warranties, consumer rights, or remedies that cannot lawfully be excluded or limited.

SECTION 18 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COLLINS CUSTOM PRODUCTS LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, PARTNERS, AFFILIATES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

SECTION 19 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Collins Custom Products LLC, Shopify, and our respective affiliates, partners, members, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, or reasonable attorneys’ fees arising from:

  1. your material breach of these Terms;
  2. your violation of applicable law;
  3. your violation of another person’s rights; or
  4. artwork, trademarks, logos, photographs, designs, or other materials supplied by you for reproduction when you did not possess the rights or authorization necessary for the requested use.

We will notify you of an indemnifiable claim where appropriate. We may control the defense and settlement of such claim at your expense, including choice of counsel, subject to applicable law.

You agree to reasonably cooperate in the defense of such claims, including by providing relevant documents or information.

SECTION 20 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.

The remaining provisions will remain in effect.

SECTION 21 — WAIVER; ENTIRE AGREEMENT

Our failure to enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies incorporated by reference and any applicable written custom-order agreement, quotation, proof approval, invoice terms, or other order-specific agreement, constitute the agreement governing the applicable transaction.

Where an order-specific written agreement expressly conflicts with these Terms, the order-specific provision will govern for that order.

SECTION 22 — ASSIGNMENT

You may not transfer, delegate, or assign material rights or obligations under these Terms without our prior written consent except where applicable law permits otherwise.

We may assign or transfer our rights and obligations under these Terms in connection with a legitimate sale, merger, acquisition, reorganization, or transfer of our business, subject to applicable law.

SECTION 23 — GOVERNING LAW

These Terms and transactions with Collins Custom Products LLC are governed by the laws of the State of California, without regard to conflict-of-law principles, except where mandatory law requires otherwise.

Subject to any consumer rights concerning venue or jurisdiction that cannot be waived, disputes arising from these Terms or purchases from Collins Custom Products will be brought in a court of competent jurisdiction in the California county in which Collins Custom Products LLC maintains its principal place of business.

SECTION 24 — HEADINGS

Headings are included for convenience only and do not limit or otherwise affect the meaning of these Terms.

SECTION 25 — CHANGES TO TERMS OF SERVICE

You may review the current version of these Terms at any time on this page.

We reserve the right, in our sole discretion and subject to applicable law, to update, change, or replace portions of these Terms by posting updated Terms on our website.

Material changes will take effect in accordance with applicable law.

The Terms in effect at the time an order is placed will generally govern that order unless otherwise required by law or agreed by the parties.

Continued access to or use of the Services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
